MINUTES
January 16, 2017

The Public Hearings that were scheduled for January 16, 2017, advertised in The Daily Star and posted in the Village regarding Local Law #1 of 2017 for Flood Damage Prevention and the Village Literacy Policy were opened at 7:00 PM.  In attendance were Mayor Kevin J. Flint, Trustee Edward A. Harvey, Trustee Louis A. Guido, Jr., Clerk-Treasurer Amy Herr, Dave Hajczewski, Int. DPW Superintendent and Dennis Laughlin, Village Attorney and Barbara Hall, Village Resident.

          Local Law #1 of 2017 for Flood Damage Prevention was reviewed by Dennis Laughlin.  There were no further questions or comments about the law.

          The Literacy Policy was reviewed by Dennis Laughlin.  This will be added to the Village Policies and reviewed annually.  It was suggested that contact be made with Frank Stock to see if he would act as an interpreter if needed as he speaks multiple languages.  He would be hired by the village to provide the service as needed.

          There being no further questions or comments the Public Hearings were closed at 7:15 PM by motion of Trustee Guido and seconded by Trustee Harvey, unanimously approved.

RESOLVED, to accept the report as given.

LOCAL LAW #1 OF 2017

          It was upon motion of Trustee Guido, seconded by Trustee Harvey, unanimously carried
          RESOLVED that Local Law #1 of 2017 for Flood Damage Prevention as authorized by the New York State Constitution, Article IX, Section 2 and Environmental Conservation Law, Article 36 has been passed along with the completion of the Intermunicipal Floodplain Management Agreement with Otsego County establishing the Otsego County Code Enforcement Office to be the Local Administrator for the law.

LIMITED ENGLISH PROFICIENCY PLAN (LEP PLAN)

          It was upon motion of Trustee Harvey, seconded by Trustee Guido, unanimously carried
          RESOLVED that the Limited English Proficiency Plan is adopted as a policy of the Village of Cherry Valley and will be evaluated on an annual basis at the annual organization meeting.

OUTDOOR SPORTS

          Jeff Stiles and Mathias VanDerwerker were present at the meeting to discuss the installation of a stage on Alden Field.  The cost of the stage will be covered by the Outdoor Sports group.  The stage will be approximately 24’ by 48’ and will be completed this spring.  The stage will be placed on the field near the current building and will not interfere with the soccer or baseball fields. 

ALDEN FIELD BRIDGE
         
          Discussion was held regarding the replacement of the bridge from the parking lot to Alden Field.  Plans for the bridge have been made and it was in the budget for this year.  This project will be started in the spring.  A temporary pedestrian bridge may need to be erected for use during the replacement project or access is available from Alden Street.  As the bridge is being built over the Cherry Valley Creek a permit will be required from the Department of Environmental Conservation.  Mayor Flint will start the process for this.

DPW

          The Christmas Decorations have been removed.

          When the power went out last week the usage calculator was zeroed out.  This is happening every time the power goes out.

          There was another ice jam last week that partially flooded Alden Field.  The ice jam cleared by itself and the water dissipated by the next day.
          Discussion was held about possible guidelines for what buildings will have their water metered if a decision is made to establish a flat rate for water usage in the Village.  This will be discussed further with the aim of having a resolution prior to the annual meeting in April.

MAINTENANCE WORKER POSITION

          Interviews were held on January 5, 2017 for the Maintenance Worker position.  Cody Duncan was hired for the position and will be starting work on Monday, January 23, 2017.

CONTRACTS WITH HISTORICAL ASSOCIATION AND LIBRARY

          Contracts have been drawn up and reviewed by Dennis Laughlin for payments in the amount of $1000.00 to be made to the Cherry Valley Historical Association to provide free admission to the museum for Village Residents and for the Cherry Valley Memorial Library to library services to the residents of the Village of Cherry Valley, without cost or charge.  Mayor Flint will contact both organizations to execute these contracts.

TERRORISM INSURANCE

          SEFCU Insurance has provided information regarding Terrorism Insurance that would be available to the Village of Cherry Valley at the cost of $186.00.  It was decided by the Board that this insurance coverage will not be purchased at this time.

ELECTION

          It was upon motion of Trustee Harvey, seconded by Trustee Guido, unanimously carried
          RESOLVED that there will be not be a village registration day in the Village of Cherry Valley for the upcoming Village Election.

          It was upon motion of Trustee Guido, seconded by Trustee Harvey, unanimously carried
          RESOLVED that the particulars of the annual Village Election to be held on March 21, 2017 are as follows:

1.     The village of Cherry Valley constitutes one election district for the purpose of village election and the polling place for such district shall be at the Village Clerk’s Office, 2 Genesee Street, Cherry Valley, New York.
2.    The hours during which the polls shall be open for voting shall be 12:00 noon to 9:00 PM.
3.    The Board of Trustees adopts a provision expanding the residency requirement to act as an election inspector to encompass all of Otsego County as there is not a sufficient number of trained election inspectors available who reside in the Village of Cherry Valley.
4.    Election Inspectors are appointed as follows:
Republican - Kathryn Lane and Marilyn Mollen
          Democrat – Claire Ottman and Norma VanBuren

          Notice has been provided to the Village Clerk that the Democratic Caucus will be held on Tuesday, January 24, 2017 at 7:00 PM at the Village Office.

          Notice has been provided to the Village Clerk that the Republican Caucus will be held on Thursday, January 26, 2017 at 7:00 PM at the Village Office.

2017-2018 BUDGET

          Plans for the 2017-2018 Village Budget are to begin.  Requests for items to be included in the budget included repairs to Alden Field, paving the walking path on Alden Field, completion of the bridge to Alden Field if not done in 2016-2017 fiscal year, street paving and sidewalk replacement utilizing CHIPS and Pave NY monies and possible salary increases.

WATER OUTSIDE VILLAGE LIMITS

          It was upon motion of Trustee Harvey, seconded by Trustee Guido, unanimously carried
          RESOLVED that residences or businesses that are outside of the Village limits and receiving Village Water services will be responsible for any repairs to the water lines to their property from the last tap, residential or commercial, within the Village limits.  Repairs to be made in a timely manner as prescribed by the DPW Superintendent or as prescribed by the Mayor or Trustee of the Village in the absence of the DPW Superintendent.

RESOLVED, to accept the report as given.

INSURANCE PRESENTATION

          Mike Hutcherson, SEFCU Insurance Agency presented the proposal for insurance coverage for the Village of Cherry Valley.  Proposals were from Argonaut with a premium of $8,159.63 per year and NYMIR with a premium of $10,150.30 per year.  Discussion was held about the coverage for 44 Main Street as portions of the building are leased.  Mike Hutcherson stated that both Art Works and the American Legion should provide the Village with a Certificate of Insurance with the Village named as an additional insured.  Dennis Laughlin stated that this may be a requirement in the leases.  Mike Hutcherson stated that at the time any renovations are done to the building there may be a need for additional riders on the insurance.  Any contractors working on the building would also need insurance and have the Village named as an additional insured.
          Motion made by Trustee Guido, seconded by Trustee Harvey, unanimously carried,
          RESOLVED that the Village of Cherry Valley will accept the proposal from Argonaut Insurance for continuing insurance coverage for the Village of Cherry Valley.

ART WORKS GRANT

          The preliminary grant application has been submitted to Senator Seward’s Oneonta Office.  If the grant is approved any work that is done must be done at the Prevailing Wage.  All projects involved that will be paid for by the grant will required to be done according to the Procurement Policy of the Village, as the Village will be paying the bills and receiving the reimbursement from the grant.

DPW

          There was a 4 inch leak on Maple Lane that has been fixed.  Rural Water helped to locate the leak and Mike Stocking did the digging of the area of the leak with his equipment.  In the spring work will need to be done on the driveway at Margaret Wickwire’s home.

          There was an ice jam by Glensfoot Farm over this past weekend that partially flooded Alden Field.  The ice jam was cleared and the water dissipated.

          Water meters have been ordered and should be in by the end of the month.  Dave Hajczewski brought up the need to replace the water meters throughout the Village as they are not able to be repaired any longer as parts are no longer available.  Discussion was held regarding various possibilities to replace the water meters.  If the meters were to be replaced all at once a bond would have to be taken out to cover the cost.  Payment of the bond could be done by raising the water rates, adding a surcharge over several billing cycles until paid for or having the residents pay for the meter in full when it is installed.  Another consideration that was suggested was looking into a flat rate for residential homes and having water meters in the commercial buildings in the Village.  Further discussion will be held when more information on costs of the various options can be explored.

          Following discussion it was decided that the draft policy for Water Rules and Regulations will be tabled at this time to possibly be incorporated into the plan for water meters.

FEMA FLOOD HAZARD/NATIONAL FLOOD INSURANCE ACT OF 1968

          A draft of the Local Law for Flood Damage Prevention was reviewed.  Motion made by Trustee Harvey, seconded by Trustee Guido, unanimously carried,
          RESOLVED that the application fee in the Local Law will be set at $0.00 and the Appeals Board will be the Flood Damage Prevention Appeals Board as established by the Village of Cherry Valley and the Board shall hear and decide appeals and requests for variances from the requirements of this local law.  Upon receipt of the Notice of Appeal or Request for Variance, the Village of Cherry Valley Board will appoint a Chairperson and four (4) Board members to hear and rule upon the appeal / variance.  Once the decision of the appointed Flood Damage Prevention Appeals Board has been filed with the Village of Cherry Valley Clerk, the appointed Board shall disband.  An Intermunicipal Floodplain Management Agreement will be completed naming the Otsego County Code Enforcement Office as the local administrator of the Flood Damage Prevention Law.

          Motion made by Trustee Guido, seconded by Trustee Harvey, unanimously carried,
          RESOLVED to hold a Public Hearing on Monday, January 16, 2016 at 7 PM regarding the Local Law for Flood Damage Prevention and the Intermunicipal Floodplain Management Agreement with Otsego County.

LIMITED ENGLISH PROFICIENCY

          Dennis Laughlin has written a Limited English Proficiency Plan for the Village of Cherry Valley.  Motion made by Trustee Guido, seconded by Trustee Harvey, unanimously carried,
          RESOLVED to hold a Public Hearing on Monday, January 16, 2016 at 7 PM regarding the Limited English Proficiency Plan.

MAINTENANCE WORKER POSITION

          Applications have been received for the position of Maintenance Worker.  Interviews will be scheduled for Thursday, January 5, 2017 beginning at 6:30 PM allowing for up to 30 minutes per interview.

LETTER WITH WATER BILLS

          A letter requesting updated contact information for Village residents was reviewed.  The letter was approved with modifications and will be sent out with the water bills.

CONTRACTS WITH HISTORICAL ASSOCIATION AND LIBRARY

          Motion made by Trustee Guido, seconded by Mayor Flint, unanimously carried,
          RESOLVED to contract with the Cherry Valley Historical Association to pay $1000.00 for the Cherry Valley Historical Association to provide free admission to the Museum for residents of the Village of Cherry Valley and to contract with the Cherry Valley Library to pay $1000.00 for the Cherry Valley Library to provide public library services to the residents of the Village of Cherry Valley commencing during the 2017-2018 Village fiscal year.

SOLAR ENERGY

          Trustee Guido has information that Solar City does not do municipal solar, but does lease municipal property to set up solar energy collectors.  Trustee Guido will contact them to have a representative come to a meeting to discuss the options available.




UPPER MAIN STREET

          Concerns have been raised about the speed limit on the curve on Upper Main Street at the intersection of State Highway 166 and Main Street.  Mayor Flint will write to Senator Seward’s office requesting a reduction in the speed limit and new signage in the area and/or an evaluation of a change in the road pattern as there have been numerous accidents at this location.
