MINUTES
October 16, 2017
Meeting opened at 7:05
PM by Mayor Guido with the Pledge to the Flag.
In attendance were Mayor Louis A. Guido, Trustee Edward Harvey, Trustee
Conway M. Bishop, Clerk-Treasurer Amy Herr and Dennis Laughlin, Village
Attorney. Also in attendance prior to
the meeting were Dick Guernsey, Todd Hull and Mark Hayes.
Prior to the meeting a
discussion was held regarding code enforcement, building setbacks and fence
regulations.
The first item on the
agenda was approval of the September minutes as members received in written
form. It was upon motion of Trustee Harvey,
seconded by Trustee Bishop, unanimously carried, to accept the minutes as
written.

It was upon motion of Trustee
Bishop, seconded by Trustee Harvey,
unanimously carried,
RESOLVED, to accept
the report as given.
DPW
The
daily reports of the activities of the DPW produced by Dave Hajczewski, Int.
DPW Superintendent were reviewed. Dave
Hajczewski has been in contact with AquaLogics about the generator at the Well
House. He is expecting to hear from them
later this week.
Discussion about the Christmas decorations was held. No new decorations will be purchased at this
time.
BRIDGE REPLACEMENT
Mike Swatling is beginning the work on the Alden Field bridge
this week. Dave Hajczewski and Mayor
Guido are getting quotes for chain link fencing on the bridge area when Mike
Swatling is done with his work.
CEMETERY
Motion made by Trustee Bishop, seconded by Trustee Harvey,
unanimously carried
RESOLVED that the
cemetery will be closed as of November 15, 2017. Burials after that date will require approval
of the Interim DPW Superintendent and the Mayor or a Trustee.
Discussion held regarding cemetery lots. The Board will not approve selling large
groups of lots at a time due to the lack of space in the current cemetery. Trustee Harvey has been approached by an
individual to see if the Village would take over a piece of land next to the
cemetery if he purchased it for his own burial space. Additional property for a cemetery will be
needed in the near future. A letter will
be written to the Cannon family to see if they would be willing to enter into a
discussion about a piece of their property near the Alden Monument.
The company that is making the new cemetery fence has been
contacted. They reported that part of
the fence is almost complete and should be installed by the end of the
month. The remainder of the fence is
still being fabricated. The pillars in
the cemetery have been pointed up by the DPW.
HISTORIAN
Motion made by Trustee Harvey, seconded by Trustee Bishop,
unanimously carried
RESOLVED to appoint Susan Murray-Miller as Village of
Cherry Valley Historian.
CREDIT CARD
The application for a credit card has been started. To complete a copy of the Articles of
Incorporation is needed. The Articles of
Incorporation should be at the County Clerk’s Office. When the clerk gets to Cooperstown to the
County Office Building they will be picked up and then the application can be
completed.
ELECTION
As Trustee Harvey’s terms will expire on the first Monday
of April, 2018, it was upon motion of Trustee Bishop, seconded by Trustee
Harvey, unanimously carried
RESOLVED that the Board of Trustees designated the
following office vacant at the end of the official year, March 31, 2018 without
primary election:
Trustee
– four year term
The polling place for the Village Election is at the
Clerk’s Office, 2 Genesee Street, Cherry Valley, NY and will be held on
Tuesday, March 20, 2018, hours 12 noon to 9 PM.
CEMETERY DEEDS
Cemetery deeds for plots sold to Bertram D. Smith &
Nancy Smith and Steven & Amy Stalzer were presented to the Board. Both deeds were signed by the Mayor and
Trustees.
OTHER BUSINESS
The Department of Environment Conservation has begun work
at 8 Lancaster Street to remove an oil tank from the basement. They contacted Annette Jusino and were told
that she does not own the property.
Discussion held about options to have the property taken over by the
County or Village. No further action
will be taken at this time.
Damage was done at Alden Field by five pre-teens. All of the parents have been contacted and
are willing to share in the cost of the repairs and completion of some
Community Service. Letters will be sent
to all of the families involved once the repair bill is received by the Village
with the final costs for each individual and any further requirements.
Mayor Guido has contacted Jeff Stiles about having the
committee that is responsible for running the community Center to also be
responsible for running the concession stand.
The Village would get 20% of the net profits from the stand. Jeff Stiles will be following up with the
committee about this.
Mayor Guido has found information in the Agriculture and
Markets Law Section 373 regarding seizure of animals lost, strayed, homeless,
abandoned or improperly confined or kept.
A culvert was put in on Montgomery Street at the Plymell
property. The Town of Cherry Valley will
be billing the Village for the culvert.
The cost of the culvert is to be billed to the Plymell’s when the bill
is received.
Mayor Guido requested a comparison of the current year’s
monthly expenses to the prior year expenses as part of the Clerk-Treasurer’s
report.
Mayor Guido is purchasing Hitching Posts and will be
donating them to the Village for placement in the Village parking lot and near
the library.

board, it was upon motion of Trustee Harvey, seconded by Trustee Bishop,
unanimously carried,
