The regular meeting of the Cherry Valley Village Board opened at 7:00 p.m. with Mayor K. Don Brigham presiding. In attendance were Trustee Jeffrey S. Stiles, Trustee Louis A. Guido, Clerk-Treasurer Dorothy E. Johnson, DPW Superintendent Kelly Wright, Dorothy Reiberg, Patti Erway, Dennis Laughlin, June Barwick, and Charles See.

SMSI – Consolidation Study

Mayor Brigham reported they are in the process of finalizing the contract which will hopefully be completed by the end of the month.

CVCFC – Rent/Water Bill

As there has been no response back from the Cherry Valley Community Facilities Corporation to the Clerk’s letter, the Clerk was told to notify them in writing that their water will be shut off if their water bill is not paid in full within the next two weeks.

MUNICIPAL BUILDING

Still no meeting has been held with the American Legion. Trustee Stiles and the Superintendent will look at the matter further next week to find the most economical way to provide the legion with heat and water without spending too much tax payer’s money. Possibly the downstairs water can be drained and shut off and the shop furnace can be used for the legion rooms.

OTSEGO COUNTY PLANNING – Referral Agreement

The Clerk will sign and return the referral agreement to the county as all have agreed on it.

Stone Repair Estimate

An estimate was revieced from Humphrey Memorials to re-set, level, and re-seal certain stones in the cemetery. It was decided to get an estimate from Cherry Valley Memorials before doing anything.

OCCA/Let It Grow - Free Trees

Erik Miller, Otsego County Conservation Association has asked the village to work with him in planting trees within the village. The trees have been donated by Rich Patalona, Let It Grow Nursery. They only ask in assistance in planting the trees.

FIRE DEPARTMENT – Use Parking Lot Memorial Day Weekend

Mickie Ward, Cherry Valley Fire Department has asked if the fire department cold use the village parking lot for the Memorial Day Weekend Celebration for food venders/crafters/flee market. The Village Board agreed to allow this.

CHAMBER MEETINGS IN OFFICE

It was agreed to allow the Chamber to use the village office for the monthly meetings (1st Wednesday), Kathryn Lane to be given a key.

CHRISTMAS CELEBRATION

Permit/Large Decorations

The Clerk has sent the permit application and proof of insurance to National Grid to hang the large decorations on their poles.
A Rose is a Rose is working on the small baskets.
Santa will be at the tree on Christmas Eve at 7 pm with oranges and Hershey bars for all area children.

The office will be closed on Christmas Eve.

OUTDOOR FURNACE – Proposed Law

The Clerk will give the Planning Board’s draft law back to them with Attorney Green’s comments for them to complete.

EMAIL LIST

Dorothy Reiberg asked to be on a list to have minutes and agendas sent to her.
Dorothy also wanted to let everyone know of their upcoming (radio) play “A Christmas Carol”.
Ms. Reiberg asked Mayor Brigham is he is resigning. The Mayor said he is not resigning at this time.

Village Board Minutes - October 15, 2007

MINUTES
October 15, 2007

The regular meeting of the Cherry Valley Village Board opened at 7:00 p.m. with Mayor K. Don Brigham presiding. In the absence of the Clerk, the Mayor took notes. In attendance were Trustee Jeffrey S. Stiles, DPW Superintendent Kelly Wright and resident Kevin Flint.

MINUTES

The first item on the agenda was the approval of the minutes, as sent to all board members in written form. The Clerk had asked to the minutes amended by having one sentence deleted – Pamela and Liz Plymell were not at the September meeting, nor did they say the village owned the land in question on Railroad Avenue; there fore it should not have been placed in the minutes. Also, the Clerk would like to express her apologies to the Plymells.
It was upon motion of Trustee Stiles, seconded by Mayor Brigham, unanimously carried,
RESOLVED, to dispense with the reading of the minutes and approve as written as amended.

No TREASURER’S REPORT due to Clerk Dorothy Johnson being absent for bereavement.

VANDALISM – Alden Field & Old School Gym

Mr. Flint suggested that the Village and Town prosecute the person who vandalized the village park and old school to the fullest extent of the law to make an “example” out of them. Trustee Stiles reported that he had been in contact with Deputy Freer and that they would be processing the arrest through the proper and usual channels. An itemized bill will be sent to the Sherriff’s Department.

PROPOSED Local 1, 2007, Regulating Outdoors Furnaces

As the draft law was incomplete, Attorney Green suggested not passing the proposed law at this time. He had comments that will be forwarded to the planning board.

RAILROAD AVE. PROPERTY

The ownership of the Railroad Avenue property that Charlie See wants to purchase from the village was again discussed. Tax maps were looked at and it seems that the village does not own the property in question. It was decided to wait for Mr. See to come in with more information supporting his position. The Clerk has also spoken to people who remember the removal of the coal tower shed, which the village owned.

SMSI – TOWN/VILLAGE CONSOLIDATION STUDY

Mayor Brigham has completed the contract with Joann Ryan, NYS Department of State on the village dissolution study. The State has to finalize the contract before the committee will convene.

NATURE TRAIL

There was no new discussion on the state of the development of the nature trail.

DPW REPORT

Superintendent Wright reported that they are picking up leaves on a regular basis and that the vandalized areas have all been repainted and repaired.

CVCFC – Rent/Water Bill

The Clerk wrote to the Facilities Corporation to see if they were agreeable to accept the non-payment of their water bill as payment in full for the rent “owed to them” by the village. Nothing has been heard back. It was decided to give them an additional 30 days to make their decision – while continuing to charge them interest.

MUNICIPAL BUILDING

It was discussed to meet with the American Legion to discuss the heating and water requirements of the village hall for the pending winter.

CEMETERY Lots Sold & Deeds Signed to:

TRICK OR TREATING

Trick or treating will be held on Wed., October 31st, hours 5:30 to 7:30. The Clerk will post notices.

REBEKAH LODGE GRANT

Mayor Brigham reported that he has been in contact with Senator Seward’s office supporting a grant requesting $36,000 by Isabella VanDewerker and the Rebekah Lodge. It was agreed to roll the outstanding grant money from last year into the total to be used to stabilize the back section of the building.

BUDGET HEARING

The Mayor opened the public hearing on the proposed village budgets at this time.


SMSI Grant – Consolidation Study

Mayor Brigham submitted a Proposed Village Dissolution Committee to be voted on at the next meeting.


NYS ENVIRONMENTAL FACILITIES CORPORATION – GRANT

Clean Water State Revolving Fund

The Board reviewed the application for funding through the Clean Water Revolving fund for a sewage project at an estimated cost of $9,350,000.


WELL HOUSE BRIDGE

Superintendent Wright suggested a weight limit be posted on the wooden bridge that leads to the well house as the bridge is used a lot by people going to the soccer games at Alden Field. It was decided to ask the county for help by providing an engineer to inspect the bridge for us and figure out a weight limit.


MUNICIPAL BUILDING

Michael Miller, Otsego County Code Enforcer has visited the municipal building with Trustee Guido to determine the feasibility of re-opening the theater. Mr. Miller feels the structure needs only “minor repairs”.

Trustee Guido said there will be a meeting on Friday with the New York Power Authority to discuss energy saving ways.


CLERK’S OFFICE

The proposed date for the move to the old school on Genesee Street is June 1. A partition has to be put up between the offices and shelves built, as well as the phone service changes.


VILLAGE JUSTICE – ABOLISH OFFICE

After consideration, it was upon motion of Trustee Stiles, seconded by Trustee Guido, unanimously carried,

RESOLVED, to abolish the office of Village Justice at the end of the current term, April 6, 2008. A public hearing with a permissive referendum will be held on Monday, May 21, 2007 at 7 pm, 44 Main Street, Cherry Valley for public comment.


MEMORIAL DAY – CHAMBER

The Chamber has requested the use of the village parking lot and sidewalks. Board members agreed that they may use them as long as the sidewalks remain open for use.


SALES TAX

Upon request of the Clerk, it was upon motion of Trustee Stiles, seconded by Trustee Guido, unanimously carried,

RESOLVED to deposit all of the May sales tax into the water fund, instead of part in general.

It was upon motion of Trustee Guido, seconded by Trustee Stiles to close the hearing at 8 pm.

MOSA/COUNTY REP.

Representative Durkin said he is on the Solid Waste committee and would like to know of any comments, questions, or concerns with MOSA as the contract will soon be up. Consultants have been hired to do a study on the solid waste.


PERMIT ITEMS – Charge back to homeowner

It was upon motion of Trustee Stiles, seconded by Trustee Guido, unanimously carried,

RESOLVED, when an item is left sitting out and the Department of Public Works has to pick it up (old furniture, etc.) the village is to charge the property owner twice the amount due. It was FURTHER RESOLVED that if the charge is left unpaid, it will be placed on the tax bill for collection. The Superintendent was asked again to pick up items at the Laura Lee, Montgomery Street residence. Ms. Lee will be billed $30.00.

Sidewalk Clearing Thank You

Thank you to all who kept their sidewalks clear this past winter and to those who didn’t pile their snow in the sidewalks. It makes for much easier clearing.

Flower Donations

In the past we have sent out letters to our merchants requesting donations toward our flowers and/or that they help out by beautifying their own property. Anyone wishing to make a monetary donation may send it to the Village of Cherry Valley, PO Box 392, Cherry Valley, NY 13320. All donations, clean up, and greenery/flowers by our residents will be greatly appreciated.

Refrigerator Pickup

Refrigerators still containing Freon gas can be taken to MOSA’s two facilities in Otsego County – Oneonta and Cooperstown at a cost of $15 each. Also scrap metal may be taken at no charge and tires at $1.75, tires with rims at $2.50 each. These and other items will still be picked up (different charges) by the garbage collector, though refrigerators and cooling units must have the Freon removed and tagged.

Museum Needs Volunteers

Are you looking for a 3 ½ hour, 2 or 3 times a month, volunteer job to help your community? The Cherry Valley Museum needs your help. Volunteers to sit at the museum between 10 – 5 daily are needed June – October. History knowledge is helpful, But NOT needed. (There are people who may be called if history help is needed.) However, you do need to be reliable, friendly, and enjoy meeting/greeting people. If you are willing to help out, please call Barb at 264-3098.

Brush Pickup

Pickup of lawn and garden debris will continue throughout the spring, summer, and fall by the DPW department. Please try to have piles that can be picked up easily. The use of wheel barrels, pails, and bags are other acceptable ways of disposal. Only in the fall do the leaves get picked up by the vacuum, and do not need to be contained.

Dog Control

Please respect others and their property and remember to have your dog(s) in your control at all times. This text is from the local dog control law:

No running at large.

No habitual barking, howling, crying, or whining.

No damaging other people’s property.

No attacking other animals.

No tampering with garbage.

No chasing, jumping on, biting, or harassing any person.

No chasing or running alongside vehicles of any kind.

No defecating, urinating on or digging anyone’s property.

No dog in heat is to be unrestrained off the owner’s property.

If you have a problem with a dog, please call the Town of Cherry Valley Dog Control Officer. (You may be required to sign a complaint form.)

RESOLVED, to accept the report as read.

NYS DOH/DEC – Sewage Issues

Robert Pierce, New York State Department of Health and Kevin O’Connor, New York State Department of Environmental Conservation spoke to the board about pursuing a septic system or sewer district for the village, due to the past failures. Mr. Pierce said that due to the limestone in the village, septic travels and may show up further away from the home to other sources (possibly wells).

Mayor Brigham said that the village has applied each year for several years through Lamont Engineering for funding for a system. He would like to see the problem fixed without bankrupting the people. Mr. Pierce said it could cost property owners an average of $450 yearly, half to pay the debt incurred in developing the system and half for usage. Also, they would have to pay for the debt charge if they are located in the system/district even if they are not hooked in.

The next step is to look for more funding. According to Mr. Pierce there may be some state funding available. Trustee Guido said that they may be able to convert the GOSC Grant to waste water next year for. Mr. O’Connor said he will get back to the Clerk with some names and numbers for the village to contact for possible resources.

GOSC – Housing Rehabilitation Grant

Mayor Brigham opened the Public Hearing at 7:45 pm to give citizens and potential beneficiaries adequate opportunity to consider the potential impacts and benefits of the community’s proposed project. The funding has been applied for through the Governor’s Office Small Cities grant.

SMSI Grant

Trustee Guido spoke regarding the Shared Municipal Services Incentive Grant Program of which the village will receive funding in the amount of $22,770 to do a consolidation (with the town) feasibility study. There will be a seven person board of directors. Mr. Guido said the town and village should meet soon (beginning of March) to discuss this matter.

LEGISLATIVE INITIATIVE – New York State Department of State

Funding for Sidewalks

Trustee Guido has applied to Senator Seward’s office for funding through the Legislative Initiative in the amount of $28,000 to replace second of sidewalk throughout the village.

Rebekah Lodge

It was decided by Lodge members that the remaining $1,600 from the grant will be used to do further repairs to the lodge roof. The Clerk will notify the Department of State that the project is not closed yet.

PLANNING BOARD – Four Hour Training

The Village Planning Board was authorized as per New York State law, to be required to receive 4 hours minimum training annually. There are online (free) courses as well as county given (and other) courses. Stacey Michael will take the information to the rest of the Planning Board. The village could have passed a resolution to waive the requirement, though decided against that.

Trustee Guido said the planning board is working on project to get an artistic view of what Cherry Valley could look like, while working on the comprehensive plan.

PATHWAY – To Alden Field

Trustee Guido has heard back from Henry Whitbeck, Jr. who is interested in having the path on a portion of his property. This should give enough room to get to the village property.

DPW Report

Superintendent Wright reported on the snow removal from the recent storm and a water pipe break on Lancaster Street.

GARBAGE CONTRACT – Bid for March

As the current refuse removal contract expires at the end of the fiscal year, May 31st, the board resolved to advertise for bids for a contract for the June 1, 2007 to May 31, 2008 year.

Legal Notice

REFUSE, RECYCLING REMOVAL BIDS

Sealed bids will be received by the Village of Cherry Valley for removal of garbage, solid waste, and recyclables for a one-year period, commencing on June 1, 2007 and ending May 31, 2008.

Specifications for the village are to provide door-to-door pickup at least once a week for regular garbage; at least once a month for recyclables and larger items – on a specified day. Larger items (furniture, appliances, metal, tires, etc.) will require a permit, purchased from the Clerk, money to be paid to the contractor at the end of each month.

COMMUNITY CENTER

Trustee Stiles said there would be another dinner in March to help raise money for the sports equipment for the gym.

The regular meeting of the village board meeting opened at 7:00 p.m., Mayor K. Don Brigham presiding. In attendance were Trustees Louis A. Guido and Jeffrey S. Stiles, Clerk-Treasurer Dorothy E. Johnson, Superintendent Kelly J. Wright, and Otsego Co. Rep. Philip Durkin.

MINUTES

The first item on the agenda was the approval of the minutes, as sent to all board members in written form. It was upon motion of Trustee Stiles, seconded by Trustee Guido and unanimously carried,

RESOLVED, to accept the report as read.

OTSEGO COUNTY REP. REPORT

County Representative Phil Durkin gave a report on the county’s recent budget and tax rate as there was an error in the budget. He said at this time, they may be refunding tax payers for the overage they paid.
He also said that some of the tourism funding had been cut, though he Cherry Valley tourist building project will still get funding as they have already shown progress.

PATHWAY – To Alden Field

LEGISLATIVE INITIATIVE FUNDS – Rebekah Lodge

The work has been completed and the Clerk will apply for re-imbursement of the remainder of the cost.

VILLAGE HALL – FURNACE

It was decided that the furnace in the village hall needs to be replaced. The Clerk got a verbal quote from Phil Ford of $2,200 to $2,300. It was decided by the board that the Clerk should get written quotes from at least three people. It was also decided that the furnace must be raised on a concrete slab.

MONTGOMERY STREET – Pavement

Mayor Brigham reported the pavement on Montgomery Street still has some loose stone but it is not a big problem. It will be cleaned up in the spring.

WATER BILL – CATHOLIC CHURCH

Karen Walker, Parish Life Associate of St. Thomas Catholic Church wrote a letter requesting a reduction on their water bill. The bill was in the amount of $1,684.98. Mrs. Walker explained that the water had been leaking from a pipe from the church leading to Kateri Hall. It had been dug up already and they thought the leak(s) were repaired. Superintendent Wright had previously met with her, a plumber, and someone to dig the area up. The request was for the village to write off $484.98, allow her to pay $750.00 now and the remaining $450.00 with the next (July) bill.
After discussion, it was upon motion of Trustee Guido, seconded by Trustee Stiles, unanimously carried to accept Mrs. Walker’s proposal.
DPW REPORT

Superintendent Wright said he will be attending the meeting of the flood map updates at the Manor on Tuesday.

CEMETERY DEED SELL BACK/MARKERS

After discussion, it was upon motion of Trustee Guido, seconded by Trustee Stiles, unanimously carried,
When the village purchases a cemetery lot back from a person, the cost they paid for markers will not be included in the refund. The person gets the amount they originally paid for the lot, only.
