April 2024 Board Meeting Minutes

 

 MINUTES

April 22, 2024

Meeting opened at 6:30 PM by Mayor Guido with the Pledge to the Flag. In attendance were Mayor Louis Guido, Trustee Edward Harvey, Trustee Ian Feulner, Amy Herr Deputy Clerk-Treasurer, Eve Bouboulis, Deputy Clerk-Treasurer, and Historic CV Business representative/resident, Noelle Adamoschek, and resident Erich Adamoschek.

Approval of the March minutes as members received in final written form from Mayor Guido. It was upon motion of Trustee Feulner, seconded by Trustee Harvey, unanimously carried, to accept the minutes as written.

It was upon motion of Trustee Harvey, seconded by Trustee Feulner, unanimously carried, to accept the report as given.

DPW

Due to an increase in debris removal to include debris left by residents hired landscapers, letters and/or notices will be sent to remind residents of resources available through the Village and expectations of residents.  Pricing of leaf bags will also be pursued to assist with clean up practices.

SPRING INTO SUMMER

Noelle Adamoschek, representative for Historic Cherry Valley Businesses, updated the Board of Trustees on the planned ‘Spring Into Summer Festival’ activities. Noelle provided a schedule of events and will be posting yard signs around the Village and surrounding area to advertise the events.  Noelle also provided insurance policy documents covering the festival dates.  Approval was sought to close the Village parking lot May 24-27, use power in the gazebo for two days, and hang banners under the “Welcome to Historic Cherry Valley” sign.  It was upon motion of Trustee Feulner, seconded by Trustee Harvey, unanimously carried, to approve the requests.

HANDICAP ACCESSIBLE RAMP REQUEST

            Erich Adamoschek, resident, requested approval to install a handicap accessible ramp at 25 Main St. The ramp would be placed on a portion of the existing Village sidewalk.  It was upon motion of Trustee Feulner, seconded by Trustee Harvey, unanimously carried, to approve the request.

BUDGET APPROVAL

            No further amendments to the budget were requested.  It was upon motion of Trustee Feulner, seconded by Trustee Harvey, unanimously carried to approve the 2024-2025 budget as presented at the Public Hearing on April 1, 2024.      

RESIGNATION OF THE CLERK-TREASURER

Resolution to remove Linda Bouck, Clerk-Treasurer from any and all accounts effective April 24, 2024 due to her resignation, appoint Amy S. Herr as Clerk-Treasurer effective April 22, 2024.  Amy S. Herr to have full powers to open and close bank accounts and as signatory rights on all accounts.  Eve Bouboulis, Deputy Clerk to be added as signatory on all accounts. Trustee Edward Harvey, Deputy Mayor to have full powers to open and close bank accounts to act in the absence/unavailability of Mayor Guido.  Continue to have Louis Guido, Mayor to have full powers to open and close bank accounts and signatory rights on all accounts. It was upon motion of Trustee Feulner, seconded by Trustee Harvey, unanimously carried to approve the resolution. Only one signature will be required to open and close accounts and endorse checks or make withdrawals from other accounts.

 

Resolution to appoint Amy Herr as Registrar of Vital Statistics effective April 22, 2024 at a rate of $250.00 per year.  It was upon motion of Trustee Feulner, seconded by Trustee Harvey, unanimously carried to approve the resolution.

OTHER BUSINESS

Discussion held to designate Mayor Guido to execute documents so the Village may be compensated $25.00 by the NYS Department of Transportation for the 2022 temporary easement on Main Street.

 

 RESOLUTION OF THE GOVERNING BODY OF THE

VILLAGE OF CHERRY VALLEY

RATIFYING AN AGREEMENT OF ADVANCED PAYMENT

 AND

AUTHORIZING LOUIS GUIDO, MAYOR

TO EXECUTE CLOSING

PAPERS ON BEHALF OF VILLAGE OF CHERRY VALLEY

 

 

WHEREAS, the State of New York has taken or is in the process of taking a portion of the land owned by Village of Cherry Valley through the process of eminent domain for the purposes of improving Main Street (St. Highway 166).

 

WHEREAS, the State has offered to pay Claimant for a portion of Claimant’s property along Main Street (St. Highway 166) as depicted on Map 88 as Parcel 177.

 

WHEREAS, an Agreement to accept said money has been signed on behalf of Village of Cherry Valley by Louis Guido, Mayor.

 

WHEREAS, the Board of Trustees of the Village of Cherry Valley is the governing body of the Village of Cherry Valley and

 

WHEREAS, the Board of Trustees is meeting on this 22nd day of April, 2024, after proper notice to consider this matter; and

 

WHEREAS, the Board of Trustees wishes to ratify the Agreement of Advance Payment and to appoint Louis Guido, Mayor, as the person to execute closing papers on behalf of the Village of Cherry Valley;

 

IT IS, UPON MOTION DULY MADE BY TRUSTEE FEULNER AND SECONDED BY TRUSTEE HARVEY,

RESOLVED THIS 22nd DAY OF APRIL,  2024;

 

THAT, the Agreement of Advanced Payment is hereby accepted and ratified;

 

THAT, Louis Guido, Mayor, is hereby designated as the person to execute any and all closing papers with regard to this transfer to the State of New York.

 

Certification of the Clerk/Treasurer of the Village of Cherry Valley

 

The undersigned Clerk/Secretary of the Village of Cherry Valley hereby certifies that the foregoing resolution was made, seconded and approved by a vote of the Board of Trustees at a meeting held at Village Office, 2 Genesee Street, Cherry Valley, NY on the 22nd day of April, 2024,

Motion to open a checking account to be managed by the Clerk Treasurer’s Office on behalf of the Village of Cherry Valley Baseball League.  It was upon motion of Trustee Feulner, seconded by Trustee Harvey, unanimously carried

RESOLVED, that a checking account is to be opened by the Village of Cherry Valley to receive monies donated to the Village of Cherry Valley Baseball League and disburse funds as needed for appropriate expenditures.

 

Motion to approve Wayne Valentine, Stacy VanBuren and Dave Hajczewski to attend the Southeastern New York Water Works Conference June 13, 2024.  It was upon motion of Trustee Feulner, seconded by Trustee Harvey, unanimously carried to approve the motion.

After review by the board, it was upon motion of Trustee Harvey, seconded by Trustee Feulner, unanimously carried to make payment on bills as follows:
